Drunk Driving and Liquor Liability Law

Attorney Arthur Licata has developed a concentration of his trial experience by handling cases involving the complex area of liquor liability as it applies to drunk driving, underage drinking, overserving or careless serving of alcohol to both minors and adults. Attorney Licata's skill in these matters is demonstrated by his victory in the Massachusetts Supreme Judicial Court.

Landmark Court Ruling

Tobin v. Norwood Country Club, Inc., 422 Mass. 126 (1996). This was the first time the court in Massachusetts had dealt with this question and it became a landmark case throughout the U.S. The Supreme Judicial Court held that bars and restaurants may be held liable for alcohol-related accidents stemming from underage drinking when alcohol is supplied to minors by intermediaries who are adults. It was the first time in which a court held that a bar or restaurant was liable for a minor's intoxication when the minor was not the direct purchaser of the alcohol.
